Draft law to criminalize arrest or pretrial detention of medical service providers

Representative Enas Abdel Halim, a member of the House of Representatives from the Future of the Homeland Party, submitted a draft law on medical liability, after obtaining the signature of 60 deputies.

In the draft law, Abdel Halim stressed that medical service providers may not be arrested or held in pretrial detention in the facts related to acts attributed to them during or on the occasion of the performance of their work, unless the report of the Medical Liability Reporting Authority acknowledges the existence of a suspicion of criminal liability.

The draft law also specifies that anyone who violates the text of the article (discussion of witnesses) will be punished with the penalties stipulated in the Penal Code for refraining from testifying and concealing evidence.

The draft law states that the status of all medical service providers working within the state will be settled within two years of the issuance of this law in the Official Gazette.​
