A fine of up to 2 million pounds .. a decision by the consumer protection regarding the shelf life of goods

The Official Gazette published in Issue 26 of 2022 Consumer Protection Agency Decision No. 1/4 of 2022 regarding the shelf life of goods.

The decision stipulated in its first article, that all producers, importers and suppliers of goods are obligated to announce the shelf life of those goods, and suppliers are obligated during that period to provide service, maintenance and spare parts necessary for the product, and they are also obligated to announce it to inform consumers.

The shelf life of goods means the period of time to provide after-sales service, which is commensurate with the nature of the product to continue to perform its function, and it starts from the date of the consumer’s receipt of the commodity or the date of activating the warranty for goods that need installation or operation.

(second subject)

The declaration of the shelf life shall be in a clear manner that is easy to read, and written in writing on the commodity itself and its packaging (if any) in a way that is difficult to remove. It shall be written on all advertisements, invoices, warranty certificates, and operating manual for the commodity, and it may be written in more than one language, one of which is Arabic.

(Article Three)

The period of time for the shelf life of goods is determined by the producers, importers or suppliers of goods, and they also abide by the general rules and legal periods for maintenance, without prejudice to the joint liability of what is said to them in accordance with the provisions and provisions of Law No. 181 of 2018.

(Article Four)

In the event of a breach of the obligations contained in this decision, the violator shall be punished with the penalties prescribed to the consumer, which provide for a fine of up to two million pounds.

(Article Five)

Those who are addressed by this decision are given a period of three months to adjust their situation according to what is stated in the decision.

(Article Six)

This decision shall be published in Al-Waqa’a Al-Masryah, and shall be effective as of the day following its publication.
